In South Africa, mediation is increasingly essential, whether mandatory or as a necessary step before litigation, as required by Rule 70 of the Magistrate’s Court and Rule 41A of the High Court Rules.

Litigation in South Africa has become inefficient and often fails to deliver the desired outcomes, due to long delays and court inefficiencies. Mediation is the ideal solution for dispute resolution because it is faster and more effective, particularly for divorces where it reduces costs and emotional trauma compared to extended court battles.

For commercial disputes, the lengthy court process makes mediation the preferred method, as it avoids the years-long wait for a court date. Property disputes following a sale and conflicts over deceased estates and trusts are also best resolved through mediation, keeping matters out of the courts and allowing for quicker resolutions.
